Innovative Analysis of Medical Law within Georgian-German Legal Frameworks
In November 2025, the European University Institute of Law published a scholarly monograph by the Institute’s Junior Research Fellow, Meri Bantsadze, titled “Defining the Scope of Physicians’ Contractual Liability and Patients’ Rights in Georgian and German Legislation”.
The book examines one of the most significant topics in contemporary medical law - physicians’ contractual liability, patients’ rights, and the distribution of the burden of proof in medical disputes. The study addresses both practical and theoretical questions that remain challenging within the Georgian legal system, particularly given that the concept of a medical service contract is not explicitly defined in Georgia’s legislative framework.
The author provides a detailed analysis of the nature of medical service contracts and the rights of the parties, physicians’ contractual and tort liability, and the standards related to patient information, consent, documentation, and cooperation. The study also explores mechanisms for protecting patients’ rights and highlights the need to strengthen relevant legal norms in Georgia.
A substantial section of the monograph is devoted to German legal experience, which, according to the author, offers an exemplary model for advancing Georgian medical law. The work additionally includes an analysis of judicial practice drawn from both Georgian and German sources.
This monograph will serve as a valuable resource for legal professionals, the management of medical institutions, as well as students and researchers.
